Terms & Conditions

Welcome to the Paradise Gifting Community ("Paradise," "we," or "us"). These Terms and Conditions govern your access to and use of the Paradise website and membership services. By becoming a member, you confirm that you are at least 21 years old and reside in the District of Columbia. Paradise is a private membership collective that facilitates gifting within the boundaries of District of Columbia law, specifically Initiative 81. The services offered are non‑commercial, and participation is contingent upon agreement with these terms. If you do not agree with any part of these terms, please do not use our site or become a member.

1. Eligibility and Membership

  • Age requirement: Membership is restricted to individuals 21 years of age or older. Although Initiative 81 addresses adults more broadly, Paradise requires members to be 21 years or older. Initiative 81 allows entheogenic plants and fungi to be gifted and used freely by people 21 and older in the District of Columbia. By joining, you certify that you are at least 21 years old.

  • Location: Membership and deliveries are only available to addresses within the District of Columbia. We do not deliver to addresses on District government or federal property or on public or private school grounds. We do not serve any jurisdiction where gifting is prohibited by law.

  • Verification: We reserve the right to verify your identity and age through government‑issued identification and may require you to upload a photo ID and a recent selfie. You agree to provide accurate and current information in all membership forms and to update us promptly if your information changes.

  • Non‑transferable membership: Your membership is personal and may not be sold, assigned, or transferred. We may refuse or terminate membership at our sole discretion if we believe you have violated any of these Terms.

2. Purpose and Non‑Commercial Nature

Paradise is an educational and social community built around gifting. Our activities are designed to comply with Initiative 81, which permits certain non‑commercial transfers of entheogenic plants and fungi in the District of Columbia. Under Initiative 81, police are directed to treat the non‑commercial cultivation, distribution, possession, and use of entheogenic plants and fungi—such as psilocybin mushrooms, mescaline‑containing cacti, peyote, and iboga—as the lowest law‑enforcement priorities. Membership contributions and donations are gifts; they do not constitute payment for entheogenic plants or any controlled substances.

  • No sales or fees for substances: We do not sell mushrooms or any controlled substances. Controlled substances remain illegal under federal law, and Initiative 81 does not legalize commercial sales. Donations and membership contributions support our community operations and educational mission; any entheogenic plant shared with members is offered as a gift and never sold.

  • Complimentary gifts: In line with the DC gift model for entheogenic plants, when you make a donation to support our community or purchase unrelated physical items, you may receive a complimentary gift such as psilocybin products. Donations or the purchase of a legal item may result in receiving psilocybin products as a complimentary gift. Gifts are not contingent on any payment for the substance itself.

3. Legal Compliance and Guidelines

Paradise operates strictly within the law. It is your responsibility to understand and comply with local, District of Columbia, and federal regulations applicable to entheogenic plants and fungi.

  • Definition of entheogenic plants and fungi: Under D.C. law, an entheogenic plant or fungus is any species naturally containing ibogaine, dimethyltryptamine (DMT), mescaline, psilocybin, or psilocyn.

  • Entheogenic plants and fungi are not legalised: Initiative 81 does not legalize psilocybin or other entheogens; it directs police to treat the non‑commercial possession, cultivation, and sharing of entheogenic plants and fungi as the lowest law‑enforcement. Adults may grow and possess psilocybin mushrooms without fear of local arrest so long as they are not selling them. It remains illegal under federal law to possess or distribute psilocybin, and commercial sales are prohibited in DC.

  • Gift Model: Commercial sales of entheogenic plants are not permitted. In DC, mushrooms are exchanged through a gift model: donations to a local advocacy organization or purchase of a legal item may result in receiving psilocybin products as a complimentary gift. Transfers of fungi must be non‑commercial and occur only between adults over 21.

  • Geographical restrictions: Initiative 81 requires staying within the District of Columbia. All transfers and consumption must occur within D.C. city limits; you should not transport entheogenic plants across state lines or onto federal property. Always keep quantities reasonable and never drive while under the influence.

  • Safe Conduct: Initiative 81 does not authorize the sale of psilocybin, and possession or use of entheogens remains illegal under federal law. Always exercise caution when using entheogens, respect the set and setting, and abide by all applicable laws.

 

4. Gifting Policies and Member Conduct

  • Voluntary contributions: All monetary contributions are voluntary gifts to Paradise. Contributions support community events, educational resources and administrative expenses. You understand and acknowledge that contributions are not payments for psilocybin or other entheogenic plants, which are provided solely as gifts when available.

  • No resale or redistribution: Gifts received through Paradise may not be resold or redistributed. You agree not to distribute entheogenic plants or fungi to anyone under 21 or to anyone for a fee. You also agree not to take gifted substances outside the District of Columbia.

  • Delivery protocols: Deliveries are limited to residential and commercial building addresses in DC that are not on District government or federal property, nor on public or private school grounds. Our couriers may request to see valid identification to confirm age and membership. If you cannot provide ID or are not present at the time of delivery, delivery may be canceled, and any contributions may be forfeited.

  • Safe storage and consumption: We encourage members to store entheogenic plants or fungi securely, out of the reach of children and pets. Psychedelics are powerful substances; you should educate yourself about dosage, set, and setting, and respect their effects. By accepting gifts, you assume all risks associated with possession and consumption.

 

5. Health and Medical Disclaimer

Information provided by Paradise is for educational purposes only and is not medical advice. Psilocybin mushrooms and other entheogenic plants can produce strong psychological and physiological effects. Consult a qualified medical professional before using any controlled substances, particularly if you are pregnant, breastfeeding, have a medical condition, or are taking prescription medication. Paradise does not diagnose, treat, or cure any disease and makes no therapeutic claims about gifted items. You agree to use gifted substances responsibly and acknowledge that you are solely responsible for any adverse effects or legal consequences.

6. Privacy and Data Use

We respect your privacy. We collect personal data, including your name, address, age, and photo identification, solely to verify eligibility, process membership applications, and coordinate deliveries. We may also record your donation history for compliance with local law. We do not sell or share personal data with third parties except as required by law or to fulfill our delivery obligations. Please refer to our separate Privacy Policy for more details on how we handle and protect your information.

 

7. Disclaimers and Limitation of Liability

  • Assumption of risk: By participating in Paradise, you acknowledge the legal complexities surrounding entheogenic plants and fungi. Although DC law directs police to treat the non‑commercial possession and use of these substances as a low priority, they remain illegal under federal law. You assume all legal and health risks associated with your participation.

  • No guarantees: Paradise makes no guarantees about the availability, quality, potency, or effects of any gifted items. Gifts are provided as‑is. We do not guarantee the accuracy or completeness of information presented on our site.

  • Limitation of liability: To the fullest extent permitted by law, Paradise and its members, directors, officers, employees, and agents shall not be liable for any damages or legal consequences arising from your participation in the community, use of the website, or possession or consumption of gifted items. You agree to indemnify and hold Paradise harmless against any claims, liability, or expenses arising from your breach of these Terms.

8. Modification and Termination

We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated effective date. Continued membership or use of the site after changes take effect constitutes acceptance of the new Terms. We may suspend or terminate your membership and access to our services for any reason, including violation of these Terms, without prior notice.

9. Governing Law and Dispute Resolution

These Terms and your membership are governed by the laws of the District of Columbia. Any disputes arising from or relating to these Terms or your participation in Paradise shall be resolved through binding arbitration in the District of Columbia, unless otherwise prohibited by law. By joining, you waive any right to participate in a class action or jury trial.
